Motion to Withdraw

This is a document that an attorney files when the attorney is getting off of the case. If clients hire a private attorney, the private attorney may withdraw if they are not getting paid, or they may withdraw if there are issues and the client / attorney are not getting along. This document basically says, “Hello Court. I was hired to represent Donald in his pending assault charge. He stopped paying me and called me an asshole. I no longer wish to represent him.”

The courts will usually grant these motions, unless they are filed very close to a trial date, for example. A judge may not let an attorney get off of the case if the judge thinks it is a tool being used to delay a hearing or a trial.
