Motion to Suppress Evidence
This is a document attorneys file when they think evidence in the case against their client was gathered or obtained illegally. It will basically say, “Hello Court. In Donald’s assault case, the cops were told Donald wanted to speak to an attorney and they continued to ask him questions. Everything Donald said should be suppressed / not allowed to be used as evidence against him because his constitutional right was violated. Cops are not supposed to continue questioning someone when they have asked for an attorney. Please order the prosecutors and cops to not be able to use Donald’s statements in the assault case against him.”
Another example may be, “The cops did not have a search warrant when they found the baseball bat in Donald’s bedroom. Since they violated his constitutional right to privacy, the baseball cannot be used as evidence in Donald’s assault case because the cops should have had a warrant.”
