Motion to Substitute

This is a document attorneys file to change attorneys. If a client hired Attorney John but then they decide they do not like John and want to hire Liza, Liza files a motion to say, “Hello Court. John is the current attorney representing Donald on his assault case. Donald now wishes to have me, Liza, represent him. Please kick John off the case and put me on the case.”

These are almost always granted because clients have a constitutional right to an attorney of their choice if they can afford to choose.

Otherwise, they will have an attorney assigned or appointed – a public defender or a court-appointed attorney. And, even then if there are issues a client can ask for a different public defender or a different court-appointed attorney
