Motion for Discovery

This is a document attorneys file usually at the same time they file their letter of representation to the court. It says, “Hello Court. I represent Donald in the assault case. I need the prosecutor to send me all of the evidence against him, including: photos, videos, statements, police reports, 911 calls, etc.”

Prosecutors, usually, will automatically send all of the evidence to the attorney representing the client once the prosecutor has gathered everything. In murder cases, for example, the defense attorney may not get all of the evidence for several months because murder cases take several months sometimes to investigate.
