Motion for a Continuance / Motion to Continue

This is a document attorneys file to move or change a court date. It’s a piece of paper that basically says, “Hello Court. We are scheduled to go to trial on January 1st. We need more time because our witnesses are not available that date (for example). Please move this to a later date.”

With any motion that is filed with the court, the Judge has the option to grant the motion, which means they say OK YES! Whatever you asked for I will GIVE TO YOU.

Or, the Judge has the option to deny the motion. The Judge can say, “No we will not delay the trial because of your witnesses, the trial date will still be on January 1st.”
